New York Municipal Opt-Outs For Retail Cannabis; Consumption Lounges

How To Use This List:

Search the database by any of the categories/fields below. Villages, towns and cities had the option to opt out of either retail cannabis sales or onsite consumption lounges, or both. If your municipality is on the list, then it opted out of whatever is listed. For example, if only “On-Site Consumption” is listed, then retail dispensaries are permitted, subject to municipal code and zoning. If both “Retail Dispensary” and “On-Site Consumption” are listed, then the municipality opted out of both. If the municipality is not listed, then both dispensaries and consumption lounges are permitted, subject to municipal code and zoning.

Keep in mind that only villages, towns and cities were allowed to opt out. Hamlets are part of the town where the hamlet is based. For example, “Valley Cottage” is a hamlet in the Town of Clarkstown. Valley Cottage is not on the list, but the Town of Clarkstown is, so it opted out for all of the town (including the hamlet of Valley Cottage). The exception is incorporated villages in those towns that made their own opt out decisions.
